1. Who we are and scope
These Terms govern access to and use of Opticue, OrderReady, and PixelPlay, including their related websites, applications, integrations, and APIs (the “Services”). The Services are owned and operated by Coding Hands Infotech LLP (“Coding Hands”, “we”, “us”, or “our”). By registering for, subscribing to, or using the Services, you agree to these Terms. If acting for an organization, you must have authority to bind it.
These Terms apply to our SaaS products. Separately agreed software development and consulting contracts govern those engagements. An expressly agreed enterprise or custom agreement takes precedence over conflicting provisions of these Terms.
2. Services and accounts
Opticue provides customer feedback management; OrderReady provides restaurant order notifications; PixelPlay provides digital signage software. Features and availability depend on the product and plan. The Services are intended for business and organizational use, and not for children. You are responsible for accurate account information, authorized user access, credential security, and activity under your account. Notify us if you suspect unauthorized access.
3. Pricing, subscriptions and payments
Services may be offered through free trials, recurring subscriptions, usage-based pricing, or enterprise agreements. The applicable price, currency, billing interval, trial conditions, and any usage charges are specified on the product website, at checkout, or in your agreement before purchase. Fees exclude applicable taxes unless stated otherwise.
A recurring subscription renews on the billing schedule disclosed at purchase until cancelled. By subscribing, you authorize the disclosed recurring charges, subject to applicable payment authorization requirements. Payments may be processed by Stripe or another processor identified at checkout. Failed or overdue payments may result in suspension. Free trials may be limited or terminated; any transition to a paid subscription is governed by the terms presented when you sign up.
4. Digital delivery policy
Our SaaS products are delivered electronically through the relevant product website or application. No physical goods are shipped and no shipping charges apply to these subscriptions. Access is provided through your registered account following successful signup and, where applicable, confirmation of payment, subject to any onboarding or activation requirements disclosed before purchase.
Trials follow the access conditions shown at signup. If a plan requires assisted setup, its delivery or onboarding schedule is specified in the applicable order or agreement. If payment succeeds but you cannot access the service, contact [email protected] with your product, account email, and transaction reference. Do not send passwords or full card details.
5. Cancellation policy
You may cancel a self-service subscription at any time through your account or by contacting [email protected]. Include your product name and account email so we can identify the subscription. Cancellation takes effect at the end of your current billing period, and you retain access until that date. Cancellation stops subsequent renewals; it does not automatically refund the current billing period.
We do not provide prorated refunds or credits for unused time, except where required by applicable law or as expressly stated in the refund policy below. Enterprise and custom agreements follow their agreed cancellation terms.
6. Refund policy
Eligible self-service paid subscription plans may qualify for a one-time 30-day money-back guarantee from the initial paid subscription purchase date, subject to fair use review, abuse prevention safeguards, and plan eligibility conditions. To request a refund, email [email protected] within 30 days of the initial paid purchase with your product name, account email, and subscription or transaction details.
Enterprise and custom agreements are excluded unless expressly agreed. Except where required by law or expressly stated in this policy, fees are non-refundable. Where approved, refunds are returned to the original payment method where possible. The time for a refund to appear depends on the payment processor and your bank; contact us for the status of an approved refund. Applicable statutory rights are not restricted by this policy.
7. Acceptable use and integrations
You must use the Services lawfully and have authority to submit and process your data. You must not upload malicious code, interfere with security, gain unauthorized access, infringe rights, abuse APIs, send unlawful communications, or engage in fraud. You are responsible for your users and connected third-party accounts. Third-party integrations are subject to their providers’ terms and may change independently.
Where AI-assisted features are offered, outputs may be incomplete or inaccurate and require appropriate human review. You remain responsible for decisions based on them.
8. Data, intellectual property and confidentiality
You retain ownership of your customer data and grant us the rights necessary to host, process, store, transmit, and secure it to deliver the Services and meet legal obligations. Coding Hands and its licensors retain rights in the software and Services. Each party must protect the other’s confidential information using reasonable safeguards. Personal information is handled as described in our Privacy Policy.
9. Suspension, termination and availability
We may modify features or suspend or terminate access for non-payment, fraud, abuse, security risks, legal obligations, or violations of these Terms. No uninterrupted availability, public service-level agreement, or guaranteed uptime is provided unless expressly agreed. Customer data may be retained for up to 30 days after termination as an operational grace period, with longer retention for backups, legal obligations, disputes, security, or contractual requirements. Data export is not guaranteed unless expressly agreed.
10. Warranties and liability
The Services are provided “as is” and “as available”. To the maximum extent permitted by law, implied warranties are disclaimed, Coding Hands is not liable for indirect or consequential damages, and aggregate liability is limited to fees paid for the Services during the preceding 12 months, unless otherwise agreed or required by law. Customers agree to indemnify Coding Hands for claims arising from unlawful use, customer data, misuse, or infringement. Neither party is liable for delays caused by events beyond reasonable control. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.
11. Governing law and updates
These Terms are governed by the laws of India. Courts in Ernakulam, Kerala have exclusive jurisdiction, subject to applicable law. We may revise these Terms periodically and publish the updated version with its revision date. Continued use constitutes acceptance to the extent permitted by applicable law.
